History Filipino Repatriation Act of 1935



along guam , puerto rico, united states acquired philippines spain following spanish–american war in 1898 , became united states territory. jones act of 1916 made official policy grant philippines independence , tydings–mcduffie act of 1935 laid out timeline , process happen, independence recognized in ten years. filipino immigration mainland united states started after philippines became territory.


during late 19th , 20th century, many asians , asian-americans faced discrimination within united states. though united states nationals, not united states citizens. filipinos not exempt nativist sentiment, particularly on west coast of united states. federal , state legislation , other polices placed limits on asian-american economic , social lives applied filipinos. repatriation act served way encourage filipinos return philippines voluntarily without officially deporting them, , way policy makers act towards domestic sentiment without international incident.


the program largely unsuccessful , transferred fewer 2,200 filipinos philippines, @ time when there on 45,000 filipinos reported in 1930 census in mainland united states. in october 3, 1938 issue of time, article entitled philippine flop reported 1,900 filipinos had returned philippines. failure has been attributed fact if filipino wished return during tenure of program facing uphill battle against quota of 50 filipinos allowed per year.


this act deemed unconstitutional united states supreme court in 1940. succeeded nationality act of 1940.
